Logging Notice Act

During the 2012 Regular Session the Logging Notice Act was passed by the Alabama Legislature.  This new law allows a county commission to adopt an ordinance requiring owners of timber to file a notice before accessing the public roads in connection with timber harvesting operations in the county.  Importantly, the law does not require that a county adopt an ordinance requiring notice, but if it elects to do so the county must follow the uniform and exclusive guidelines laid out in the law.

 The Association of County Commissions of Alabama (ACCA) has published model forms for the adoption of such ordinances and is encouraging county commissions to use them.  After reviewing these forms with legal counsel, we conclude that the model ordinance appears to violate the law in many respects and if adopted may be invalid.  We alerted ACCA of the problems but they plan to continue to promote their forms.

 The model forms were designed without the participation or support of the Alabama Forestry Association.  While we supported the enactment of the law, we never supported, and strongly contest, the model ordinance ACCA is circulating.  We plan to soon take appropriate action to bring this matter to final resolution so that county commissions can be assured of what is permitted under the new law.
